The California Supreme Court has interpreted this instruction as follows: “One is not eligible for commitment under the [Act] unless his or her capacity or ability to control violent criminal sexual behavior is seriously and dangerously impaired.” (See People v. Williams (2003) 31 C4th 757, 776-77.)
