When searching Forecite California, there are shortcuts you can take to find the information you are looking for:

1. By Code Section:

Forecite uses standard abbreviations for different types of codes. Those abbreviations can be found below:

Using these codes to search is very simple. For example, if you wanted to search for Penal Code section 20, you would type PC 20 into the search box.

2. By CALJIC Number:

Since Forecite is indexed to CALJIC, searching for CALJIC numbers is easy. For example, to search for CALJIC 3.16, you would type 3.16 into the search box.

3. By Case Name or Citation:

To find a case or citation, simply enter all or part of the case’s citation. Since many cases are known only by one name involved, it is often helpful to not search for the entire citation. For example, if you were searching for references to People v. Geiger (84) 35 C3d 510, 526 [199 CR 45], you could search for People v. Geiger or just Geiger. Searching for Geiger might be more helpful since it would find references to the case that do not include the full citation.

In multiple defendant cases where the availability of lesser offenses may depend on the particular defendant’s role, instruction upon lesser included offenses as to one defendant and not the other may impermissibly imply to the jury that the judge has made a determination as to the defendant’s role in the case.

CALCRIM 3517 lists the greater and lesser offenses and then tells the jurors that: “It is up to you to decide the order in which you consider each crime and the relevant evidence ….” The instructions do not say jurors must consider lesser offenses whose definitions may actually include elements or sub-elements of the greater offenses. (See e.g., murder and attempted murder.)

Accordingly, either the CALCRIM deliberation instruction or the instruction defining the elements of the greater offense should be modified to assure that the jurors are required to consider and determine whether any sub-elements have been proved beyond a reasonable doubt. (See e.g., FORECITE F 520.6 Inst 1 [The CALCRIM Instructions Fail To Make It Clear That Absence Of Passion/Quarrel And Absence Of Imperfect Defense Are Prerequisites Which The Jurors Must Find Before Convicting The Defendant Of Murder Or Attempted Murder].)
