B. Definition May Be Required Of Non-Technical Term If Jury Expresses Lack Of Understanding
While commonly understood terms need not be defined for the jury, if the jury expresses a lack of such “common understanding”, the court’s underlying obligation to assure that the jury understands its duties (see FORECITE PG IX(D)(1) and (2)); see also People v. Kirkpatrick (94) 7 C4th 988, 1025 [30 CR2d 818], Mosk, concurring) suggests that the term should be further defined.
For example, in People v. Solis (2001) 90 CA4th 1002 [109 CR2d 464], the jury asked for a definition of “sustained” fear as used in CJ 9.94. The Solis court found that the court’s refusal to define the term was error.

C. Reference To Jury Service Materials When A Term Is Not Defined
If a term is not defined in the instructions the common dictionary definition should control. However, in some cases the jury may have been given jury service information which includes definitions of terms. (See e.g., “A Guide to California Jury Service” located at http://www.courtinfo.ca.gov/jury.) If the term is defined in the jury service materials it may be possible to argue that the jury relied on that definition at trial.
