F 18.33 n1 Striking A Police Dog: “Without Legal Justification” Is A Technical Term (PC 600).
In People v. Black (94) 23 CA4th 667, 671 [28 CR2d 546], the court held that the term “without legal justification” is a term which has a technical meaning peculiar to the law and, hence, the jury must be instructed regarding what constitutes legal justification in a prosecution for unlawful striking of a police dog in violation of PC 600.
