F 18.21 n2 Hazardous Waste: Strict Liability of Corporate Executive For Hazardous Waste Violation (HS 25190). (HS 25189.5, HS 25113, HS 25117, HS 25124, 26 CCR 22-66260.10, 26 CCR 22-66261.24, 26 CCR 22-66261.26).
“Persons holding significant shares of corporate responsibility and power are subject to prosecution and conviction for strict liability crimes unless they have exercised their responsibilities in power so as to have undertaken all objectively possible means to discover, prevent and remedy any and all violations of such laws.” (People v. Matthews (92) 7 CA4th 1052, 1062 [9 CR2d 348].) In other words, the only defense to such a strict liability crime is that the corporate executive was “powerless to prevent or remedy” the violations.
