F 16.145 n2 Misdemeanor Sexual Battery: No Actual Skin Contact Required.
People v. Dayan (95) 34 CA4th 707, 715-17 [40 CR2d 391] held that the touching required for misdemeanor sexual battery (PC 243.4) does not require actual contact with the skin. Hence, the court recommended that CJ 16.145, which includes this requirement, be revised.
